Terms of Sale
Last updated: October 22, 2026
Thanks for shopping with Damon Howatt. We are a small shop in Lebanon, Oregon, and every bow we sell is built by hand, one at a time. These terms explain how buying from damonhowatt.com works: how orders are accepted, what happens when something is out of stock or mispriced, how payment and tax work, and what we each agree to. We have tried to keep it in plain English. If anything here is unclear, just ask us.
By placing an order on damonhowatt.com, or by sending us a reservation request for a bow, you agree to these Terms of Sale, our Shipping & Returns page, and our Privacy Policy.
Who we are
Damon Howatt bows are made and sold by Damon Howatt Productions LLC, 1940 River Rd, Lebanon, OR 97355, USA.
- Email: HowattArchery@Gmail.com
- Phone: +1 541-870-4661
When we say "we", "us" or "Damon Howatt" in these terms, we mean Damon Howatt Productions LLC. "You" means the person placing the order or sending the reservation request.
What these terms cover
These terms cover purchases made through the online store at damonhowatt.com and reservation requests for made-to-order bows sent from our model pages (see Reservations and custom builds below). They do not cover:
- Purchases from an authorized dealer. Those are between you and the dealer, though our Limited One-Year Warranty still applies to the bow (see Warranty below).
- Giveaways and sweepstakes. Each promotion has its own official rules, which control for that promotion. For example, the SN# 24169 Giveaway has its own rules page on this site.
- Dealer or wholesale accounts. Dealer pricing and terms are provided separately once a dealer application is approved.
You must be at least 18 years old to place an order. If you are younger, please have a parent or legal guardian place the order for you.
Placing an order
When you click "Place Order", you are making an offer to buy. We accept that offer when we ship your order (or, for a backordered bow, when we confirm your build slot by email). Until then, we can decline or cancel an order for any reason, including the reasons in the next sections. If we cancel, we refund you in full. A bow reserved through a model page is different: our payment email is our offer, and your payment accepts it (see Reservations and custom builds below).
Our automatic order confirmation email confirms that we received your order and your payment, and it serves as your receipt. It is not yet acceptance of the order; acceptance happens when we ship, as described above.
Please click "Place Order" once and give the page a moment to finish. If anything goes wrong at checkout, email or call us and we will take care of it. If a duplicate order does slip through, tell us and we will cancel and refund the extra one.
Pricing, availability and honest mistakes
All prices are in US dollars. Prices, sale prices, options and stock levels can change at any time without notice. The price shown at checkout when you place your order is the price you pay (for a bow reserved through a model page, see Reservations and custom builds).
Most of what we sell is a one-of-a-kind bow with a serial number, and once it sells it is gone. As our product pages put it: "Each bow will show as OUT OF STOCK once sold and will not be available until we either put more bows in process, or have new available stock."
We are a small team and we make mistakes. If a listing shows an obviously wrong price, a wrong draw weight or handedness, or stock we no longer have, we may cancel the affected order and refund you in full, even after you receive a confirmation email. We will tell you why.
Some products have per-customer limits, which are stated on the listing. For example, the printed catalog is "Limited To 1-Per Customer" and the premium bow sock has a limit of five per person at its sale price. If an order exceeds a stated limit, we may reduce the quantity and refund the difference, or cancel the excess.
One-of-a-kind inventory and order cancellation
While you are in checkout, the items in your cart are held for you for a short time (currently 30 minutes) so that nobody else can buy them out from under you. If you do not complete payment in that time, the hold is released and the items go back on sale. Because many bows are single units, two people can still occasionally try to buy the same bow within moments of each other. If that happens, the first order that completes payment gets the bow and we cancel and fully refund the other. We will let you know.
If a bow is damaged, lost or otherwise unavailable before it ships, we will contact you and offer a comparable bow, a build slot for a new one, or a full refund. The choice is yours.
Cancelling your own order. If you change your mind before your order ships, email us with your order number and we will cancel and refund it in full. Once an order has shipped, use the return process on our Shipping & Returns page instead. For backordered or in-process bows, see the next section.
Blemished ("blem") and discounted bows
We grade bows on a simple scale and say so in the listing title, for example "10/10", "9/10" or "8/10". A 10/10 bow has no cosmetic flaws we could find. A 9/10 or 8/10 bow is sold at a discount because it has a cosmetic blemish, which we describe and photograph on the listing. In our own words from those listings:
"Blemished: This bow may have some small blemishes that does not affect usability or warranty and is discounted to reflect this fact."
"The blemish on this bow does not affect functionality or performance and comes with the same 1-YR original warranty that all brand news carry."
Blemished bows are brand new, not used. As every bow listing states: "ALL BOWS ARE NEW WITH A MAX OF 5-10 TEST SHOTS AND ALL COME WITH A LIMITED 1YR WARRANTY." Blemished bows are also covered by the 30-day money-back satisfaction guarantee described on our Shipping & Returns page, exactly as our blem listings say.
The blemish is part of the description. Please look at the photos before you order. A cosmetic blemish that was described and shown in the listing is not a defect and is not a basis for a warranty claim.
Backordered and in-process bows
We do not automatically take backorders. You can only order a bow that is not yet in stock if the listing is explicitly labelled "Backordered" or "Available on backorder" (or "In Process") and shows a lead time. Everything else is sold only from stock on hand.
Our standard lead time for a backordered bow is around 5–7 weeks. If a listing states a different build time for that particular bow, the listing's time applies to that bow. An "In Process" bow is one where, as a listing says, "Part of this bow is complete, but it still has 3-5 weeks remaining in the build process."
Each bow is hand-built, so lead times can stretch when wood, glass or shop time run short. A lead time is an estimate, not a guaranteed delivery date. If we cannot ship your bow by the estimate, we will email you before it passes with a new estimate, and you can cancel for a full refund. If the new estimate is more than 30 days after the original one, or if we have to delay a second time, we will ask you to confirm that you still want the bow; if you have not confirmed by the date in that email and the bow has not shipped, we cancel the order and refund you in full. A delay by itself is not a defect.
Backordered bows are paid in full at checkout, like every other order, and the lead time starts once your payment is confirmed.
You can cancel a backordered or in-process bow at any time before it ships, for a full refund. Email us with your order number.
Reservations and custom builds
This section applies to reservation requests sent from our model pages. Models that are not in stock are not sold through the cart. Model pages for bows we are taking reservations for have a reservation form. Here is how a reservation works:
- You send the form. That puts you on the waiting list for that bow, in the draw weight, length and handedness you chose. It is not an order: nothing is charged, and we do not ask for payment details.
- We confirm your place in line. We reply by email to confirm your reservation and your place in line. That email states the draw weight, length and handedness you chose, the version where a model page shows more than one price (for example the Savannah's curved or straight inlay), the locked price where the model page locks it in, and our current estimate of the wait, and it links to these terms. If you have not heard from us within a few business days, please contact us.
- We email you when it is your turn. When your bow is ready to be started, we email you the final lead time for the build and a request for payment. Nothing is charged until you pay that request. Once you have paid, your bow is on order: we have accepted it, and we will cancel it only for a reason given in Pricing, availability and honest mistakes or Payment, always with a full refund. Otherwise it is handled like a backordered bow (see Backordered and in-process bows above): the lead time in our payment email is the one that applies to your bow, and it is an estimate. If we cannot ship by it, we will email you before it passes with a new estimate, and you can cancel for a full refund at any time before the bow ships. If the new estimate is more than 30 days after the original one, or if we have to delay a second time, we will ask you to confirm that you still want the bow; if you have not confirmed by the date in that email and the bow has not shipped, we cancel and refund you in full.
Price. Where a model page says the price is locked in when you reserve, we honour the price shown on that page for the model and version you reserved on the day we received your reservation request, even if our prices go up while you wait. If our price for that bow is lower when we take payment, you pay the lower price. The locked price is the price of the bow; shipping is added at our rates at that time and shown in our payment email before you pay, and there is no sales tax. If a model page does not say the price is locked in, the price shown there is our current price, and the price in our payment email applies.
Paying on time. Our payment email gives you a pay-by date at least 14 days away. If you need more time, ask us before that date. If we have not received your payment by the pay-by date (or a later date we agreed), we may treat the reservation as cancelled: your place goes to the next person in line and the price lock ends. Tell us if you still want the bow and we will put you back on the waiting list at the price current then.
Lead times. How long you wait depends on the model and on how many people are ahead of you. The lead-time figures on a model page and in our site footer are our current estimates; the lead time that applies to your bow is the one in our payment email, and it is an estimate, not a guaranteed delivery date.
Cancelling a reservation. Before you pay, you can cancel at any time by emailing us; as the model pages say, your place in line then goes to the next person. After you pay, you can cancel at any time before the bow ships for a full refund, like any backordered bow. If you want to change the draw weight, length or handedness, tell us before you pay.
Product descriptions and natural materials
Every Damon Howatt bow is "100% Hand-Crafted in the USA" from natural wood, fiberglass and, on some models, carbon fiber. Grain, color and figure vary from bow to bow. For one-of-a-kind listings, the photos show the actual bow you will receive. For stock items like strings and stickers, photos are representative ("Please see photos for the actual stickers you will be receiving" means the sticker designs, not a specific physical sheet).
Draw weights are marked at a 28-inch draw unless the listing says otherwise. As one listing explains, "If your draw is higher than 28″, weight will increase by around 1.4LB per inch of draw". Where a listing gives an "exact draw" figure, that is the weight we measured on that bow. Otherwise, actual draw weight may vary slightly from the marked weight, which is normal for hand-built bows.
Each bow ships with a full-flemish string, an arrow rest, a basic bow stringer, a manual and a shipping box, as described on the listing. Optional upgrades (silencers, premium stringer, bow sock) are only included if you selected and paid for them.
Payment
We accept payment by credit and debit card through Stripe, including Apple Pay and Google Pay where your device supports them. Your card details are entered directly into Stripe's secure payment form and are never stored on, or sent through, our own servers. Stripe may run fraud checks on your payment.
Your card is charged in full when you place the order, including for backordered bows. For a bow reserved through a model page, you pay when you pay our payment email; nothing is charged before then. All charges are in US dollars; if your card is issued in another currency, your bank sets the exchange rate and may add a fee.
If a payment fails, is reversed, or is flagged as potentially fraudulent, we may hold or cancel the order and ask you to verify your identity or billing details before we ship.
Sales tax
We are based in Oregon, which has no sales tax, and we do not charge sales tax on any order, wherever it ships. Your order total shows a sales tax line of $0.00. If your own state asks you to report use tax on out-of-state purchases, that is between you and your state.
On orders shipped outside the United States, import duties, taxes and customs fees may be collected by the carrier or customs authority before delivery; they are not included in our prices or shipping charges and are the buyer's responsibility.
Shipping
We ship to the United States, Canada and Great Britain; other countries are not currently served. Shipping options and prices are shown at checkout before you pay and depend on what kinds of items are in your cart and where it is going; stickers add nothing to the shipping charge. For international orders, duties, import taxes and customs fees are the buyer's responsibility. Processing times, carriers, and what to do about a lost or damaged package are all on our Shipping & Returns page, which is part of these terms.
Returns and the 30-day money-back guarantee
We stand behind our bows with a 30-day money-back satisfaction guarantee. As our product listings say: "All bows come with a 30-day money back guarantee, if you don't like it you can send it back for a full refund minus shipping charges." The details, including the return window, condition requirements, and how to start a return, are on our Shipping & Returns page, which is part of these terms.
Warranty
Every new Damon Howatt bow comes with a Limited One-Year Warranty against defects in material and workmanship, given to the original purchaser by Damon Howatt Productions LLC. The full warranty, including everything it does and does not cover and the step-by-step claim process, is on our bow registration page, is summarized on our Shipping & Returns page, and is part of these terms. In short:
- How long. One year from the date of original purchase (the date on your order confirmation or dealer receipt).
- Who. The original purchaser only. The warranty is not transferable.
- Registration. Please register your bow on our registration page within 30 days of purchase. Registration records your purchase and gets you expedited support; if you did not register, you can still make a claim by showing proof of purchase.
- Not covered. Strings, rests, stringers and other accessories; normal wear; cosmetic blemishes described in a blem listing; and damage from misuse, such as dry-firing, arrows lighter than 10 grains per pound of draw weight, the wrong brace height, stringing a bow without a stringer, heat, or alterations.
- What we do. Repair the bow, or replace it if it cannot be repaired. Ask us for a Return Authorization (RA) number before shipping a bow; you pay shipping to us, and we pay the return shipping if the claim is covered.
The Limited One-Year Warranty is the only express warranty we give on a bow. Strings, stringers, stickers, bow socks and other accessories are sold without a written warranty; if one arrives defective, tell us within the 30-day guarantee window and we will make it right. See Disclaimer of other warranties below.
Safety: please read before you shoot
A bow stores a lot of energy and can hurt you or someone else if it is misused or damaged. Our registration page says it plainly: a bow is inherently dangerous if it is misused, damaged or neglected, and by purchasing or using our products you agree to use them safely and to take responsibility for how you use them.
By buying and using our products, you agree to the following:
- Read the manual before you string or shoot the bow. Every bow ships with one.
- Use a bow stringer, every time. "Twisting your bow between your legs to string your bow is not recommended and will void your bow warranty."
- Never dry-fire. Shooting the bow without an arrow can destroy it and injure you.
- Use arrows that are heavy enough. Our warranty excludes damage from shooting arrows lighter than 10 grains per pound of the bow's marked draw weight. Lighter arrows behave like a partial dry-fire.
- Use the correct spine and brace height for your bow, as given in the manual or on the listing.
- Inspect the bow before every session. Stop shooting immediately if you see a crack, a lifted lamination, a twisted limb, string fraying or anything else unusual, and contact us.
- Store the bow unstrung, dry, and out of heat (not in a hot vehicle).
- Supervise young archers. Youth-sized bows are still real bows.
- Know and follow your local laws on archery, hunting seasons, and where you may shoot.
If you are not willing to accept these responsibilities, do not use the bow. Contact us for a full, no-questions-asked return and refund before you use the bow or open the sealed plastic bag it ships in; you pay the shipping charges back to our shop. That offer is part of our 30-day money-back guarantee: an unopened, unused bow returned within the 30-day window is refunded in full except for shipping charges.
Disclaimer of other warranties
EXCEPT FOR THE LIMITED ONE-YEAR WARRANTY ON BOWS DESCRIBED ABOVE, WE SELL OUR PRODUCTS AS DESCRIBED ON THE LISTING AND WITHOUT ANY OTHER EXPRESS WARRANTY. ANY IMPLIED WARRANTY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, IS LIMITED IN DURATION TO ONE YEAR FROM THE DATE OF PURCHASE FOR BOWS, AND TO THE 30-DAY MONEY-BACK GUARANTEE PERIOD FOR ALL OTHER PRODUCTS. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. This section does not take away any right that the law does not let us limit.
Limitation of liability
To the fullest extent the law allows:
- Our total liability for any order is limited to the amount you paid us for that order.
- We are not liable for indirect, incidental, special, consequential or punitive damages, including lost profits, lost hunts, travel costs, or damage to arrows, targets or other equipment, arising from a product or from your use of the store.
- Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by our negligence, or for fraud.
Some states do not allow the exclusion or limitation of incidental or consequential damages, so parts of this section may not apply to you. You may have other rights that vary from state to state.
Your information and your conduct
We do not offer customer accounts. Every order is a guest checkout: you enter your contact and shipping details for that order, and we email you the order confirmation, tracking and any refund notices at the address you gave us. Please make sure it is correct.
You agree to give us accurate contact and shipping information, and not to use the store for fraud, resale under a false identity, or anything illegal.
Giveaways and sweepstakes
From time to time we run giveaways. Each one has its own official rules posted on this site (for example, the SN# 24169 Giveaway rules), including eligibility, entry methods, and the states where it is void. Those rules, not these Terms of Sale, govern that promotion.
Dealers
If you bought your bow from an authorized dealer, your purchase, returns and exchanges are governed by that dealer's policies. Our Limited One-Year Warranty still applies; you can make a claim through the dealer or directly with us.
Governing law
These terms, any order you place, and our Limited One-Year Warranty are governed by the laws of the State of Oregon and applicable US federal law, without regard to conflict-of-law rules.
If something goes wrong: dispute resolution
We would much rather fix a problem than argue about it. If you have a complaint, email us first at HowattArchery@Gmail.com with your order number. Most issues are solved with a conversation.
If we cannot sort it out between us within 60 days, either of us may bring a claim in the state courts located in Linn County, Oregon (the county our shop in Lebanon is in) or in the United States District Court for the District of Oregon, and you agree to the personal jurisdiction and venue of those courts. Either of us may instead bring a qualifying claim in small-claims court where you live or where we are located.
Changes to these terms
We may update these terms from time to time. The version posted when you place an order or send a reservation request is the one that applies to that order or reservation. The date at the top shows the current version.
The fine print
- Entire agreement. These terms, the Shipping & Returns page, the Privacy Policy, and your order confirmation (or, for a reserved bow, our reservation confirmation and payment emails) are the whole agreement between us for your order.
- Severability. If a court finds part of these terms unenforceable, the rest still applies.
- No waiver. If we let something slide once, that does not mean we have waived our right to enforce it later.
- Assignment. You may not transfer your order or these terms to someone else without our okay. We may assign them if the business is sold or reorganized.
- Things outside our control. We are not responsible for delays or failures caused by events we cannot reasonably control, such as carrier disruptions, severe weather, wildfire, supplier shortages, or utility outages.
